Conor O’Dwyer Update
Conor’s latest comments on his blog, Shame on Cyprus are, “I suspended my vigil in London 17th October after 74 days and nights and took November off from all things Cypriot to rest with my family. Until the investigation concludes and charges made I feel I must continue with 2 & 3 day protests whenever the President of the Republic visits London. If no justice is forthcoming it will be with great regret that I will resume the indefinite vigil in the Spring of 2009.”
But a letter dated 26 November from the Office of the Attorney General of the Republic of Cyprus was published on the internet yesterday which says “we hereby wish to inform you that the Police have completed their inquiry, the file has been studied and it has been ascertained that no criminal offence has been committed.”
This is clearly very disappointing news for Conor and his family and the hope is that his legal team can overcome this setback and can resume their quest for justice.
Certainly on his blog, Conor talks about European Law, “The 2006 assault and the in action of the Cypriot authorities will now be looked into by a European Human Rights QC.”
This decision is causing great concern to other property buyers and owners in Cyprus who are relying on the registration of their contract at the Land’s Office to protect their position until Title is transferred to them and a Certificate of Registration is issued in the names of the buyers.
But Cyprus Law does, according to a document we found by using Google, contain the following warning.
Section 8 of the Criminal Code (entitled, “Bona fide claims of right”) provides that, “A person is not criminally responsible in respect of an offence relating to property, if the act done or omitted to be done by him with respect to the property was done in the exercise of an honest claim of right and without intention to defraud.”
One problem, again found on Google, is that the “Law” finds it so difficult to define “intent to defraud”.
