The lastest incident in the case of Conor O’Dwyer highlights a new fear that must now be settling on those who are in dispute with a developer in Cyprus.  Conor was already taking an appropriate action in the Cyprus Courts through a Cyprus Lawyer.  But he has also published a “no holds barred” web site and film clips on You Tube.

The Cyprus Informer wishes Conor a speedy recovery and ultimate success with his legal action.

As the Cyprus Informer has already said the Cyprus Property Market is in need of urgent legal reform.  Conor O’Dwyer’s case demonstrates that buying off plan is too risky.  His lawyer had lodged the signed contract between him and the developer at the Land Registry.  Presumably by some legal loophole in the Cyprus Legal System it has been possible for the developer to lodge another contract with another buyer at the Land Registry.  If this can happen then the law under which people buy of off plan builds without Title Deeds is seriously flawed.

The only advice the Cyprus Informer can give is to implore property purchasers in Cyprus not to buy off plan unless you can afford to lose all the money and risk hospitalisation if you object.

If you want to buy in Cyprus then the only safe ways are to buy the land first and get the Title Deeds issued into your name at the same time that you pay for the land or purchase a re-sale but only where again the Title Deeds are put into your name at the same time that you pay for the house and the land.  But even then before you pay over the money to the seller at the Land Registry do ask the Land Registry Staff to provide you with a search in writing, in English, showing that there is no mortgage or any form of encumbrance on the land. Take no chances and get a good, recommended lawyer.

Only buy from people who can fulfil everything that you need to make your purchase safe.

And to those who have experienced frauds please take great care in the publicity you give your case on internet web sites,You Tube, Internet Chat Rooms, Forums, Newspapers and even the major TV channels because in Conor’s case he became a target for violence.
