Hope Yet of Second Planning Amnesty for Cyprus?
A few years ago the Government of the Republic of Cyprus declared an amnesty for planning control violations going back some years.
It now looks like the Cyprus Government is going to tackle the problem again but this time by a Bill which should also deal with the more serious issue of mortgages taken out by developers that has already been sold.
Hopefully the many small planning infringements that are holding up the issue of long awaited title deeds will have been solved once and for all without waiting for years for the next periodic amnesty.
The problem is the extent of the red tape demanded by local councils when the developer requests the Certificate of Final Completion. If any planning issue is discovered, even very,very minor ones which were inadvertantly not covered when the planning permission obtained, for example a few centimetres in the depth or width of a window, then the local council invariably declines to exercise any discretion and refuses to issue the vital Certificate that is needed to get the title deeds transferred to the buyer. The developer then has to submit full plans again with the error shown asking for a fresh planning permission. This can take years to resolve and many cannot because of other changes in procedures that occur between the first planning permission and the request for a change cover note.
In the UK this would be covered by Building Regulations rather than planning during the build on a pragmatic rather than bureaucratic process.
